The former personal attorney for Donald Trump has resigned as the chief federal prosecutor in the state. This decision was prompted by a judicial decision that questioned her right to serve.
Attorney General's Statement
The nation's top law enforcement official, Pam Bondi, announced Habba's resignation on the start of the week. Bondi stated that the appeals court finding made it unworkable for Habba to perform her duties.
"Let no one confuse following the order as giving up," Habba stated. "This battle will now stretch across the country."
Legal Background
Her resignation follows closely on a judicial panel found that she had been acting without proper authority as US attorney. This judgment is likely to affect many prosecutions in New Jersey.
The appellate judges declared that a acting appointment that bypassed confirmation by the US Senate ran afoul of the statute on vacant positions.

It was also stated that Habba will stay on at the DOJ as a high-level advisor. Habba plans to pursue additional appeals of the disqualification, with hopes of a different outcome.
In a statement, she argued that the court "cannot be permitted to second-guess the President's choice of prosecutors tasked with carrying out the fundamental role of the presidency of enforcing the law."

The 41-year-old attorney, was initially recruited to Donald Trump's lawyers in 2021. Subsequently, she defended the former president in his hush-money trial in 2024, leading to his guilty verdict on dozens of charges of document fraud.
Earlier, assuming the federal prosecutor position, the former president had announced he was naming her as his presidential counsellor in a potential future term, calling her as "unwavering in her loyalty" and a relentless legal advocate.
